The Commission Regulation (EU) No 965/2012 (Pravilnik za letachki operacii, SV na RSM 283/2020) laying down technical requirements and administrative procedures related to air operations was amended by Commission Regulation (EU) 800/2013 published on August 14th, 2013.

This amendment includes the requirements for non-commercial operation of complex motor-powered aircraft (Part-NCC). Operators of complex motor-powered aeroplanes (CMPA) and helicopters involved in non-commercial operations shall declare their capability and means to discharge their responsibilities associated with the operation of aircraft and operate the aircraft in accordance with the provisions specified in Annex III (Part-ORO), Annex VI (Part-NCC) and Annex V

(Part-SPA) to Commission Regulation (EU) No 965/2012.

These rules in Republic of North Macedonia are applicable as from 01 April 2021.

Definition of complex motor-powered aircraft

‘complex motor-powered aircraft’ shall mean:

(i) an aeroplane:

  • with a maximum certificated take-off mass exceeding 5 700 kg, or
  • certificated for a maximum passenger seating configuration of

more than nineteen, or

  • certificated for operation with a minimum crew of at least

two pilots, or

  • equipped with (a) turbojet engine(s) or more than one

turboprop engine, or

(ii) a helicopter certificated:

  • for a maximum take-off mass exceeding 3 175 kg, or
  • for a maximum passenger seating configuration of more than nine, or
  • for operation with a minimum crew of at least two pilots, or

(iii) a tilt rotor aircraft.

Affected Operators

The following are operators that shall submit a declaration to MKD CAA;

a) All operators that operate/manage non-commercial operations with a CMPA registered in an MKD CAA register having the principal place of business or residence in Macedonia;

b) All operators that operate/manage non-commercial operations with a CMPA registered in an MKD CAA register having the principal place of business or residence in Macedonia and aircraft stationed outside Macedonia.

Declaration Process

It is the responsibility of the operator/owner to submit a Declaration Form (OPS- FRM-022 DECLARATION SPO and NCC англиско-македонска)  to MKD CAA. The declaration form shall be completed in its entirety and submitted for verification.

MKD CAA will acknowledge receipt of the declaration within 10 days of receipt of the same.

Apart from the information required by the Declaration form, operators shall also submit the following documents –

a) NCC.IDE for aeroplanes or helicopters (as applicable)

b) Minimum Equipment List;

c) Application forms for Specific Approvals (SPA) required;

d) Compliance checklist and statement (OPS-CHK-022 Compliance Checklist and Statement -PART NCC)
